Patent costs

The filing fee covering the first two years for patents and certificates of addition is 180,000 Ariary . Other rates apply depending on the type of service requested.

Registration of patents, trademarks, designs and models

AMadagascar, the Malagasy Office of Industrial Property (OMAPI) issues patents for inventions, in accordance with the provisions of Ordinance No. 89-019 of July 31, 1989 establishing a regime for the protection of industrial property and the decrees of subsequent application (decrees no. 92-993 and no. 92-994 of December 2, 1992).
To protect your industrial properties (trademark, patent, design and model) apply for registration with the Malagasy Office of Industrial Property.

A patent is an exclusive right conferred by the State on an invention which is new, and which involves an inventive step and is capable of industrial application. Anyone wishing to patent their invention submits an application to OMAPI, provided that it meets the criteria and conditions for patentable invention pre-established by the Office.

    What are the rights arising from the patent of invention?

    When the patent has been granted for a product : Right to prohibit third parties from manufacturing, importing, offering for sale, selling and using the product

    When the patent has been granted for a process : Right to prohibit third parties from using the process; to manufacture, import, offer for sale, sell and use the product resulting from the use of the process.

    What to do in case of infringement of rights on a patent for invention?

    For any infringement of the rights attached to patents (product counterfeiting) is punished by imprisonment of three months to two years and a fine of 160,000 Ariary to 6,000,000 Ariary or one of these two penalties only

      Organization in charge:

      OMAPI is the global body responsible for intellectual property services, policies, information and cooperation. Thus, it manages the administration of industrial property and the promotion of inventive activity in Madagascar.

      OMAPI issues Industrial property titles (patents for inventions, product or service mark registration certificates, industrial design or model registration certificates, trade name registration certificates). It is placed under the technical supervision of the Ministry in charge of Industry. Titles granted by OMAPI are published in the Official Industrial Property Gazette (GOPI).
