Investor access to land ownership

Through legal texts such as Law No. 177/AN/91 2nd L of October 10, 1991 on the organization of land, the Republic of Djibouti has undertaken vast reforms to facilitate access to land ownership for Djiboutian or foreign investors. .

These legal and institutional arrangements allow any Djiboutian or foreign investor, man or woman eligible for the benefits and guarantees of the investment code, to buy, rent or resell land belonging to the State or to a private owner. We will present in the table below a description of the services in charge of the management of land domains, procedures for access to land in Djibouti.

Registration procedure

There are two types of registration procedure

1. Registration by notification, by order or by deed of sale

  • Per notification

This is an acquisition of a plot of land in a subdivision.

1. Submitting an application;

2. Acquisition of the plot by notification (payment period 30 days)

3. Payment of the amounts mentioned on the notification:

  • At the Domaines checkout;
  • At the tax office
  • At the Central Bank (for VRDs for certain subdivisions)

4. Deposit with the sub-directorate of land conservation:

5. The original notification;

6. Copy of all receipts and receipts;

7. The 16 stamps of 1000 DJF.

8. Transmission of these last documents to the sub-directorate of the cadastre:

9. Establishment of a site plan;

10. Drafting of a verbal report;

11. Update of the cartographic database (SIGeAC) of the plot.

12. Establishment of the registration certificate

13. Delivery to the interested party of the registration certificate and location map upon presentation of the identity document.

  • By order

These are plots allocated for public establishments, or real estate projects for ministries and large-area plots allocated to real estate developers.

  1. Establishment of a stop é with location plan;
  2. Transmission of the decree for approval and signature;
  3. Registration of the decree at the tax office for the plots affected free of charge;
  4. Implementation of the notification if the plot allocated is paying;
  5. Filing of the decree or notification to the land registry for registration.
  6. The original notification;
  7. Copy of all receipts and receipts;
  8. The 16 stamps of 1000 DJF.
  9. Transmission of these last documents to the sub-directorate of the cadastre:

  • By deed of sale

There are two types of acts:

  • State housing deeds:
  1. A deed of sale is put in place;
  2. Signature of the act by the Minister of the Budget;
  3. Settlement at the estates fund of the amount due by the new purchaser;
  4. Registration of the deed at the Hôtel des Impôts after payment of the amount of the registration;
  5. Submission of the deed of sale to the sub-directorate of land conservation;

The rest of the procedure is the same as a simple notification.

  • Deeds from Notaries
  1. Filing of the deed at the Direction;
  2. Verification of the parcel in the cartographic database;
  3. Receipts of the sum of;
  4. Submission of the deed to the sub-directorate of land conservation;

The rest of the procedure is the same as a simple notification.

2. Registration by notification, by order or by deed of sale

These are sales of plots of land in the old districts of the city of Djibouti processed by the Habitat Fund.

  1. Filing of the file for the amicable transfer to the Department of Estates and Land Conservation by the Habitat Fund;
  2. Establishment of a report by the sub-directorate of the cadastre;
  3. Update of the parcel in the cartographic database;
  4. Establishment of the registration certificate; 5.
  5. Transmission of certificates of registration to the Housing Fund

The costs of the different types of real estate transaction, land conservation and taxes

Fixed fees:

  • transfer of ownership,
  • Mortgage,
  • Of final concession,
  • Cancellation of mortgage

Are 2% of the market value of the land title and 3% registration fees.
